Business and Commercial Use

Our website offers credit card terminals, point-of-sale equipment, accessories, supplies, and related services for business and commercial use. By placing an order on behalf of a business, you represent that you have authority to bind that business to the applicable purchase terms.

Purchases and use of our website are subject to our Terms of Service, Privacy Policy, Refund Policy, Shipping Policy, and any applicable written agreement. This notice supplements those documents. A separately executed agreement controls in the event of a conflict concerning its subject matter.

Product Information and Compatibility

We make reasonable efforts to maintain accurate product descriptions, specifications, pricing, and availability. Errors or omissions may occur. Product images are illustrative; included components, condition, software, and features are those identified in the applicable product listing or written quotation.

Payment terminal compatibility depends on factors that may include the payment processor, acquiring bank, gateway, software version, encryption keys, connectivity, region, and required certifications. Unless we expressly confirm compatibility in writing for your specified configuration, you are responsible for verifying these requirements with your payment processing provider before purchasing.

A terminal purchase does not, by itself, include a merchant account, processing approval, software license, activation, programming, key injection, cellular service, or ongoing support unless expressly included in the offer.

Payment Processing and Third-Party Services

Merchant accounts, payment processing, financing, software, connectivity, and other third-party services may require separate applications, approval, fees, and agreements.

Purchasing equipment does not guarantee approval for payment processing, any particular processing rate, transaction acceptance, funding schedule, or business result. Third-party providers control their own services and contractual obligations. Our responsibilities are limited to those we expressly undertake in the applicable agreement.

Security and Compliance

Purchasing a terminal, including a device described as PCI approved or EMV capable, does not by itself establish that your business or payment environment complies with PCI DSS, payment network rules, or applicable law.

You are responsible for the compliance duties applicable to your business, including secure installation and operation, access controls, device inspections, and required assessments. Responsibilities expressly assigned to us in a written agreement remain our responsibility.

Do not send full payment card numbers, security codes, PINs, passwords, or encryption keys through ordinary email or website contact forms.

Warranties

Any manufacturer warranty is subject to that manufacturer’s terms, eligibility requirements, and claim procedures. Any warranty provided directly by North American Terminals must be expressly stated in the applicable product listing or written agreement.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT FOR EXPRESS WARRANTIES WE PROVIDE, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THIS DISCLAIMER DOES NOT NEGATE AN EXPRESS WARRANTY OR EXCLUDE RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED.

Returns and warranty claims are governed by the applicable published policy or written agreement.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NORTH AMERICAN TERMINALS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM THE WEBSITE OR PRODUCTS OR SERVICES WE SUPPLY, INCLUDING LOST PROFITS, LOST REVENUE, BUSINESS INTERRUPTION, OR LOST DATA.

OUR TOTAL AGGREGATE LIABILITY ARISING FROM A PRODUCT OR SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PARTICULAR PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

These limitations do not apply to fraud, willful misconduct, gross negligence, or any liability that applicable law prohibits us from limiting or excluding.

Intellectual Property and Trademarks

Website content owned by North American Terminals or its licensors is protected by applicable intellectual property laws. You may not reproduce or commercially distribute that content without permission, except as permitted by law.

Third-party names, trademarks, logos, and product images belong to their respective owners. Their use identifies products or compatibility and does not, by itself, imply sponsorship, endorsement, or an authorized reseller relationship.

Links to third-party websites are provided for convenience. We do not control those websites and are not responsible for their content, security practices, or policies.
